Client dentist was accused of negligence and incompetence in overmedicating a patient during sedation for a dentistry procedure and in discharging the patient prematurely, resulting in the patient’s ER visit and admission to hospital on suspicion of oversedation. Patient reported the dentist to the Michigan Department of Licensing and Regulatory Affairs (LARA), and the dentist received an administrative complaint.
Our Michigan healthcare regulatory and licensing attorneys filed an answer and obtained a supportive opinion from an M.D./D.D.S expert. We examined the treatment records both at the dental practice and during patient’s hospital stay, as well as patient’s complaint to LARA; in doing so, we discovered numerous inconsistencies. Our lawyers researched and provided published studies regarding the specific sedation medications used and how the dentist’s actions were within the standard of care. We obtained witness statements from clinic employees and provided dentist’s certificates of completion of continuing education and certification in sedation dentistry.
We ultimately resolved the case through negotiations following a compliance conference for dismissal of two of the three charges against our client and payment of a nominal fine.
