Primary Issue:
A Michigan physician was raided by the DEA and the local police department after a thorough investigation into his prescribing practices. He immediately contacted Chapman Law Group after the raid, but not before he signed a DEA form 104 surrendering his prescribing privileges.
Result:
Our goal was two-fold: (1) prevent prosecution, and (2) restore his prescribing privileges. We immediately obtained the records for the patients in question, and we found that the physician’s prescribing practices were not illegal but arguably fell short of the DEA’s requirements for prescribing controlled substances. It is imperative in these types of instances to aggressively negotiate with the DEA to show that the physician shouldn’t be charged. We also needed to restored the physician’s DEA registration so that the family practice could remain operational.
We contacted the DEA and began negotiations by offering a compliance program to bring the physician back into compliance with the DEA’s requirements. The DEA agreed and permitted the physician to prescribe non-narcotic controlled substances in an effort to show compliance and eventually have the physician’s DEA registration fully restored. The DEA also agreed not to prosecute the physician. He continues to practice medicine in Michigan.
