The Appalachian Region Prescription Opioid (ARPO) Strike Force targeted East Tennessee as part of a federal initiative to combat prescription drug misuse. After a three-month undercover operation at a family clinic, a respected local physician became the focus of a federal criminal investigation. Prosecutors alleged that the doctor had unlawfully distributed controlled substances. On the advice of another attorney with limited experience in healthcare law, the physician was urged to plead guilty to drug conspiracy and unlawful distribution charges. However, the physician sought a second opinion from the healthcare defense attorneys at Chapman Law Group before proceeding.
After thoroughly reviewing the case, Chapman Law Group of counsel federal criminal defense attorney Meggan Sullivan identified significant weaknesses in the government’s theory and evidence. Our team obtained and analyzed medical records, interviewed key witnesses, and carefully reconstructed the prescribing patterns that prosecutors claimed were unlawful. Our findings revealed that the physician’s treatment decisions were clinically justified and consistent with accepted medical standards.
Following these findings, Chapman Law Group advised the client to reject the government’s plea offer. Over the next two years, Meggan engaged in extensive negotiations with federal prosecutors, challenging their interpretation of the evidence, demanding disclosure of investigative materials, and highlighting the government’s inability to prove criminal intent. Every plea offer was declined during negotiations, signaling our firm’s confidence in the strength of the defense.
Ultimately, after a hard, long fought battle, the government agreed not to prosecute or indict the physician. The case concluded in a victorious manner for Meggan, and more importantly the physician. There were no criminal charges, which in turn preserved the physician’s medical license, reputation, and career.
