Case Result: After Outburst, Argument Over Mask Removal During Licensing Exam, M.D. Candidate’s Passing Score Retained

Primary issue:
Client, an M.D. candidate for licensure, got in trouble while taking the exam through the U.S. Medical Licensing Examination (USMLE). Apparently, Client removed his COVID-19 mask in the middle of the examination and was approached by the proctor, who forced them to put it back on. However, there is no mandate in the state of Florida that requires masks (the state governor had states that schools cannot force a mask mandate, and the exam was in a state university).

When Client approached the proctor during a scheduled break to discuss the interruption and the mask mandate, an argument ensued. Client received a disciplinary letter from USMLE for “disruptive behavior,” which can carry such penalties as cancellation of exam scores and prohibition from taking the exam again, either temporarily or forever, including report to Federation of State Medical Boards.

Argument:
Our Florida healthcare license and regulatory lawyers attended a hearing to present our arguments and assert that Florida does not have a mandatory mask mandate.

Result:
The USMLE determined that behavior even during scheduled breaks can be disruptive. Client’s only punishment is a report on his USMLE file. Client’s scores, which are passing, were released. Client will most likely be able to explain the state issues regarding this novel problem to the Florida Board of Medicine, given that this is state specific.
