Case Result: LARA Dismisses Administrative Complaint Against Pain Management Specialist Accused of Negligence for Not Sending Patient to ER for Alleged Nerve Injury

Pain Management Specialists

Primary issue:
Client Pain Management Physician was accused of negligence and failing to transfer a patient to the ER after alleged nerve injury to the patient during cervical facet injections. Patient reported the physician to the Michigan Department of Licensing and Regulatory Affairs (LARA).

Our Michigan healthcare regulatory and licensing lawyers prepared client for the LARA investigator interview and provided documentation of:

  • patient’s movement during procedure as cause of alleged injury;
  • patient’s failure to bring forth complaint of specific symptoms post-procedure that would have led to a transfer to the ER;
  • clinical guidelines and publications documenting the alleged injury was a known risk of the procedure; and
  • evidence of physician’s completion of relevant continuing medical education and letters of support from colleagues.

The case was dismissed by LARA without further action.
