Primary Issue:
A physician was excluded from participation with Medicare and Medicaid for committing healthcare fraud. After the reinstatement of his medical license, he applied for a certificate of registration with the DEA. The DEA was considering rejecting his application solely due to the exclusion issue, even though his license had been reinstated.
Result:
By arguing that the physician’s registration was not contrary to the public interest, and by providing facts and supporting documentation to the diversion investigator, we were able to demonstrate that the physician being granted his registration would not harm the public. We further argued that if the DEA should deny his application, it was substantially likely he would succeed in an administrative case. We continued to work with the DEA to assist them in providing additional evidence to help support our position. In the end, the DEA granted a complete registration.
