A Michigan dental hygienist’s license was suspended for failure to enter into a contract with the Health Professional’s Recovery Program (HPRP) following a DUI. We petitioned for dissolution of the summary suspension and were granted a hearing before an administrative law judge.
After successful cross examination of the State’s witnesses at the hearing, the judge gave a directed verdict in our favor after our showing that the state failed to prove their case. The judge dissolved the suspension and the hygienist returned to practice that day.
