We successfully negotiated an arrangement to permit immediate reinstatement of the RN’s license following assessment by a mental health professional deeming our client safe with probation.
Through a series of tough negotiations with the prosecutor and by portraying a strong defensive position, we were successful in dismissing four of the five counts and obtaining diversion pursuant to MCL 333.7411.

Primary Issue:
A Michigan registered nurse was suspended for failure to enter in to a monitoring agreement with the Health Professionals Recovery Program (HPRP) following an out-of-state conviction for public intoxication. Her nursing license was suspended for allegations of having an impairment detrimental to her practice of nursing. We petitioned for dissolution of the summary suspension and were granted a hearing before an administrative law judge.
Result:
After successful cross-examination of the state’s evaluator at the dissolution hearing, the judge gave a directed verdict and returned the nurse to practice that day. We obtained a directed verdict by showing the judge that the state failed to prove its case. Our attorneys’ due diligence eliminated the impairment charge from the administrative complaint.
