Primary issue:
In an administrative complaint, client neurosurgeon was accused of negligence and incompetence. The allegations came from a patient, who claimed that the neurosurgeon had failed to timely diagnose and treat a spinal infection, leading to additional hospitalization and surgery.
Argument:
Our Michigan healthcare regulatory and licensing lawyers filed a response and worked with the neurosurgeon to obtain six supportive expert opinions and extensive additional medical records. We demonstrated repeated non-compliance by the patient; provided published studies showing that the neurosurgeon’s treatment was fully within the standard of care; and offered supportive letters from the neurosurgeon’s staff regarding their interactions and conversations with the patient.
Result:
Following a lengthy compliance conference with the chairman of the Board of Medicine, which included a PowerPoint presentation, the Board dismissed the administrative complaint.
