Case Result: Case Dismissed, Letter of Guidance for Nurse With THC in System After Using Edibles Outside of Florida

Primary issue:
Client nurse was accused of testing positive for THC in a pre-employment drug screening. Client had many serious medical issues and had been trying different medications over the span of several months. Client’s family suggested marijuana to alleviate symptoms. Client believed that if using marijuana for this purpose was successful, client could determine whether obtaining a medical card in Florida would be a potential option.

Client visited family who lived in another state, where marijuana had been legalized for recreational purposes, and tried using edible THC. Client had a scheduled drug test for pre-employment, and intentionally waited to make sure all was fine. However, the THC was still in Client’s system. (There are reasons for this, as edibles are harder to remove from the body, but there was clearly no possibility that client was impaired after that much time had passed.)

Argument:
Our Florida healthcare license lawyers did not want to give the Florida Department of Health (DOH) any admission, and we opted reserve response until after review of the investigation file.

Result:
The case was dismissed with a letter of guidance, which is non-disciplinary.
