Case Result: RN Reported by Employer for Drug Diversion Has Board of Nursing Case Dismissed

Primary Issue:
A registered nurse was terminated by his employer for suspected drug use and drug diversion following high usage Pyxsis report.

We obtained the complete personnel file, the urine drug screen results, fit-for-duty assessment, and an independent substance abuse evaluation by a HPRP-approved provider. Our licensing attorneys thoroughly prepared the RN for his interview with the state investigator. During the investigator interview, the RN was able to explain the high-usage Pyxis report due to his position as a charge nurse and preceptor in the ICU. The substance abuse evaluation and drug screen results confirmed there was no evidence of drug use.

The case was closed following the meeting with the investigator, and no disciplinary action was taken against the RN.
