Primary Issue:
An RN who was on prescription medications was terminated and reported for drug diversion.

The RN retained our attorneys immediately following termination from employment to defend the nurse against allegations of drug diversion. Prior to being contacted by a state Investigator, we advised the RN to take proactive measures in preparation for an investigation into the alleged drug diversion. We obtained the employment file, urine drug screen results and statements by co-workers. The RN was on prescribed medications, but the UDS results were reported as “out of range.” We obtained an independent substance abuse evaluation and consulted with a pharmacology expert. We were able to provide an explanation as to why the UDS was “out of range,” and the substance abuse evaluation confirmed there was no abuse or drug diversion of narcotics. We presented the information, explanation, and documentation to the State Board of Nursing Analyst to review.
Result:
The case was closed prior to any action being taken.
