Client nurse was arrested for felony DUI after an altercation with a police officer. Client was in their vehicle, stopped, in a parking lot. The officer approached client to ask them to get out of the car. Client refused to cooperate. Police insisted client seemed drunk and therefore arrested them for DUI. Client’s criminal case was not yet resolved when the Florida Department of Health (DOH) opened an investigation for possible impairment and crime as related to the practice of nursing.
Result:
Upon review of the evidence, and the fact that client was not convicted and there was no proof he was an alcoholic, the case was dismissed.
