Primary issue:
Client RN was terminated from a hospital as a result of a drug diversion allegation. The hospital found some narcotic discrepancies and asked the RN to take a drug test. Fearing criminal consequences from non-disclosure, the RN admitted that testing would produce a positive result for several drugs, some of which the RN had a script for. The RN was consequently reported to IPN but rejected enrollment and a Florida Department of Health (DOH) investigation ensued.
Argument:
We denied the allegations and obtained negative hair test to prove the RN was not impaired.
Result:
The case was subsequently dismissed due to lack of evidence.
